Read these terms before you use the Site. They include an arbitration clause and class-action waiver, and explain that Molariva is not a dental or medical provider.

01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Molariva, a brand of The Nelson M Group LLC ("Molariva," "we," "us"). They govern your use of molariva.com and related services, among them email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Anyone who does not agree to these Terms must stop using the Services.

02What Molariva is, and is not

Molariva is an information service. We publish general, plain-language information about oral health, dental care basics, and ways to save on dental care, and let visitors opt in to related updates. We will not offer dental care, give quotes or prices for treatment, match people with dentists, or refer people to providers, and we do not share your details with dental offices, insurers, or any other business partners.

• Decisions about dental care are yours. Reading our content does not obligate you to do anything.
• Your own dentist, not Molariva, examines you, explains the risks, benefits, and costs of any treatment, and is responsible for your care.
• Costs, coverage, and savings vary by person, plan, and location. We will not guarantee that you will save any amount, qualify for any program, or get any particular result.

03Eligibility

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Services. You may only submit information about yourself, or about another person who has authorized you to do so.

04Your information and accuracy

You are responsible for supplying accurate, current information and for updating it when it changes. Only a mobile number you own or are authorized to use may be provided. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

Opting in means you agree to hear from us by email and, for the boxes you check, by automated texts as explained in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-551-0282.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

The next are prohibited: (a) submitting false or misleading information, or information about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example public health resources, dental schools, or clinics) are managed by third parties, not by us. We do not recommend any product, plan, or provider, and we are not answerable for their conduct, content, or results. Your relationship with a dentist or plan is between you and them.

09Intellectual property

The Services, like the Molariva name, logo, text, graphics, and design, belong to us or our licensors and are protected by intellectual property law. You receive a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial reasons. Photographs on the Site are used under their own free-use licenses.

10Disclaimers

The services and all content are supplied "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Molariva does not provide medical advice, and makes no representation about any dental treatment, plan, price, savings amount, or health outcome.

11Limitation of liability

To the fullest extent permitted by law, molariva and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any dental care decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

In jurisdictions that do not allow certain limitations, those limitations may not apply to you. These Terms never limit liability that the law says cannot be limited.

12Indemnification

If your violation of these Terms, your misuse of the Services, or your submission of a phone number or other data you were not authorized to provide leads to claims, damages, or expenses (including appropriate attorneys' fees), you agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel.

13Disputes, governing law, and arbitration

Informal resolution first. Before you file any claim, reach us at [email protected] giving us 30 days to try to work it out.

Binding arbitration. Small-claims matters and claims for injunctive relief against intellectual-property misuse are excluded. Any other dispute between you and Molariva or The Nelson M Group LLC that arises out of or relates to these Terms or the Services will be settled by final, binding, individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules. You choose whether the arbitration takes place in your county of residence or by video or phone. The arbitrator can grant the same individual relief a court could, and any court of competent jurisdiction may enter judgment on the award.

Class-action waiver. You and Molariva each waive, to the extent the law permits, any right to bring claims as a plaintiff or class member in a class, collective, or representative action; claims may be brought on an individual basis only.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration Opt-Out", stating your name and mobile number.

Governing law. We interpret these Terms under the Federal Arbitration Act and the laws of the state where The Nelson M Group LLC has its principal place of business, ignoring conflict-of-law rules. The state and federal courts based there have exclusive jurisdiction, subject to the arbitration clause.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Violations of these Terms, among other things, may lead us to suspend or terminate access at our discretion. Sections which by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and disputes) will.

15Changes

We may update these Terms. We will post the new version with a new "Last updated" date. If you continue to use the Services after the effective date, you accept the updated Terms. For material revisions, we will provide notice as mandated by law.

16General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
